mommanlhh: What is the fastest way to have the biological father sign over his rights to my son?
My son is almost 4 and his biological father has been out of his life for most of his life. The last time he saw him was in Feb. 2008. I recently got married and would like for my husband to adopt my son, as he has been in his life even before he was born. He is the only father that my son knows.

go get a lawyer and have it court ordered. I think any judge that sees a worthless father will happily have it done. Its in the best interest of the child. If they feel that you and your new husband are whats good for him. Not sure how the system works but you might have to prove to them why hes an unfit father. by the sounds of it, that doesn’t seem like its going to be a problem.
If the bio-father agrees to this, you and your husband must be the one to file a petition with the court to start the proceedings, the bio father does not do that part. It’s simple. The bio father must agree to it. But you are the one who has to do the leg work and bear the financial burden. That’s what the laws of most states require. There is no fast track for this legality. There is a standard procedure for this according to the laws in your area.
The fastest way is to start now. If he is in full compliance, it will move as fast as the court allows and not sooner. When all parties have agreed, the judge makes the ruling and it’s done.
Answer by CoeyGYou have to take him to court but that doesn’t guarantee that he will sign. Not seeing his son for a year isn’t going to sway the court. He has to agree to it, if he doesn’t then your husband can’t adopt your son.
