Well my fiancee called the paramedics due to having shortness of breath. She got admitted to the hospital, later that evening the cops showed up to the house went into my closet and confiscated my firearm. Is this legal?

Is it registered? Are you able to own a firearm (not a felon, etc.)? If so, I think this is totally illegal. Contact a lawyer ASAP.

Why would the cops show up at your apartment later just because your fiance went to the hospital?
Seems your fiance shared something with the cops, your not sharing with us.

If you have a gun license and you havent killed anyone with it, there is absolutely no reason for anyone to take your gun.
I know for a fact that it is illegal for them to take your gun specially without consenting the owner.
I suggest seeking out help from a lawyer.

If the cops came for no reason whatsoever and there was no reason to suspect a crime had taken place and she did not give them permission to search the premises or a search warrant was not issued then no it is not legal.Answer by redhotboxsoxfan
Well, lots fun questions there.
1. Who is on the rental agreement. If your fiancee then yes they can check the house.
2. Is or did your fiancee say she was suicidal, or wanted to hurt someone? if so again yes.
3. If the gun is illegal and she told the police you had it, then again, if her name is on the lease, then yes.

There needs to be a reason for the cops to search your home w/out a warrant and shortness of your wife breath is not what I would call a reason.
That being said, if the gun is registered and you carry a license to have a weapon, then that too is illegal.
I would get an attorney to work on this one.

It sounds like she told them you had a gun in your closet. Is it legal to have a gun where you live? Is it legal to have it in the closet, as opposed to in a locked container (some localities have really repressive laws)? Is your firearm a type that is legal to own where you are? Was it loaded? Is that legal where you are? Are you a felon or otherwise prohibited from owning or possessing a gun?
If your firearm was legally owned, possessed, and stored, then they had no right to do that, and you should take legal action if you want the gun back. Understand that the cost of taking such legal action may vastly exceed the monetary value of the firearm. This is one of the reasons police departments get away with this sometimes.

Did your girlfriend mention the gun?
Who’s on the lease?
Did that person give permission?
Do you have a concealed weapons permit?
Was it in plain view?
Was it a long gun or a handgun of some sort?
Need more information. If you haven’t done anything wrong, go to the P.D. and get it back, If you’re hiding something, you’ve just lost yourself a gun.
