: What happens if the mother who has custody don’t show up to a contested custody hearing?
The mother has custody now and the father would like to gain sole custody. If granted custody he is willing to let the mother have a relationship with the kids only if she goes to rehab and finds some stability. She tried to manipulate the father by telling him court was cancelled. Which is not the case at all. Either she really believes that court is cancelled or she don’t want him to show up. But after all she is a drug user and really stupid too! So what if she don’t show up?

Whomever does not show up loses be default. Unless the lawyer does and can get it rescheduled. ALWAYS call the court to make sure. There is a reason they are ex’s.
My husband’s ex did exactly the same thing! Can’t believe it. He got custody of the kids. My guess is the same will happen to the father.
The court will ALWAYS let you know if a hearing is cancelled. They assume that you have no contact with the other party.
