Stephanie: If children are orphaned and a family member takes them in, how long until they can move in?
I have just always wondered: If a child/children are orphaned, how long until the children can move in with a willing relative who would like to adopt?
Do the children have to spend a few days in the foster system for any reason or do they automatically move in as foster children?

From a physical standpoint, custody is temporarily given to family, friends or neighbors in the aftermath of a dire tragedy.
Legal custody is a matter for probate court to attend to. The will of the parents can name guardians and probate court can award custody.
Transfer of physical custody of the children is handled with the best interests of the children in mind.
CPS doesn’t come into the situation if at all possible. The state takes custody reluctantly if absolutely no one else is available.

They can m,move in immediately and court would be scheduled very soon to make it legal—guardianship or custody.Adoption is a longer process—must reside in that home at least 6 months before adoption would be processed.No you wouldn’t move in as a foster child—nothing is automatic in child welfare.
