What to do when a car repair shop do unauthorized repairs to your car and will not release it?

cmickeygirl: What to do when a car repair shop do unauthorized repairs to your car and will not release it?
I have been with out my car for more than 2.5 months the repair shop keep doing a miss and miss, cause to call it a hit and miss would be lying. To this day the car is not running. Now to release my car it will cost me over $ 600 for repairs I didn’t tell them to make on my car. Since I have a new car I really don’t care if it sits there for a lifetime, but can they sale my car parts without having title to the car? And I am responsible for the repair cost that I didn’t authorized them to do?

you should call your insurance company. They will have more legal pull and most insurance companies will work to help you out even if you just have liability. (State farm is probably the best at doing this.)

The business can put a chattel lean on your vehicle.
If you are in the US; pay for the repairs with a check. (make sure there are sufficient funds in the account) On the check, note,:”paid under protest.” Then file a civil suit in the county/parish where the business is located.
That way you won’t loose the vehicle and you can keep your credit in tact – and the Civil Court should be able to sort it out for you. Be sure to bring the cashed check, the original repair estimate, and any other evidence with you to court.
You should also file a complaint with the Department of Consumer Affairs, your state Attorney General, and the Better Business Bureau.

Good luck!

State laws vary, but I know some places will place a lean on your vehicle and if you do not take it within 30 days they will legally become the new owners. Its a dirty practice that they do. Talking to some corporate bigwigs at the place might help, also try talking to lawyers, your insurance co., and even file a police report if things get bad. A dealership here fried my electrical system when I took in for a tune up and kept my car for 5 months while they tried to find parts.
