ROCKER_CHICK: What happens to the children during the divorce process?
What happens to a child when a husband and wife are still in the divorce process? Once they have filed for divorced, they are no longer living together, and waiting on their court date to finish the divorce and decide custody. In between all that, what happens to the child? If they are technically still married, couldn’t one parent take the child and run away with them? What could the other parent to if that were to happen? Before custody and divorce hearings, both parents still have custody, so what happens until the court actually enforces who gets the child and when?

This is the most difficult part of a divorce. You’ve asked many questions – I will try to help. The divorce process can be a very long, tedious process, and there are many ways to go about the divorce. When children are involved, one must take action. The court will issue a temporary custody order until a hearing can be held. At that time, it is usually settled as far as visitation and support are concerned. It is not wise for one parent to “run away” with the child(ren). The court does not look highly upon this, even if the couple is “legally” married. If it were to happen, the first and best thing to do would be to contact the court. In all of this, it is critical to shield the child(ren) as much as possible. It is important to let them know that mommy and daddy splitting up is not their fault and that both parents love them
