Ryan K: If I rent an apartment..is it legal for me to rent it out to someone else?
A friend of mine said he has an apartment (that he is paying rent on) and he is planning on furnishing his apartment and renting it out to someone else. Just out of curiosity, is that legal for him to do that?
……if it is legal…how would I go about doing so myself?

Yes, its called sub-letting.

Subletting is definitely legal however it will be up to the landlord to determine whether or not it is allowed. Most leases will state the rules and regulations regarding subletting. If you are renting you must talk to your landlord about your intentions. If you get the okay the subletting lease is between you and your tenant, your tenant is not the landlords tenant however they must follow all the rules in your lease with the landlord and your lease is still binding with the landlord. It is also your responsibility, for liability issues, to inform the landlord who is living in the home. The rent for the sublet is paid to you and in turn you pay the landlord for your rent. You have a lease with the tenant and are not obligated to provide a copy to your landlord. As you are a landlord under a sublet you must follow all the laws in your state regarding repairs, inspections, evictions. security deposits and the like. Do your research on the subject to protect yourself from issues that may or may not come up. Under a sublease always make sure that there is a written lease for either a term or month to month.
