islandprincess: How can I bring my mom to live in the United States permanently and legally from another country?
My mom lives in Western Samoa. I am over 18 and I support myself. Please do not suggest anything illegal, my mom wants to work and live here legally.
I am a legal citizen born and raised. My mother’s visa ran out and she went back overseas.

I would get hold of imigration and ask what it would take to get her a visa and make her perminate . Each country has different rules on that . You might haveto contact ppl in somoa . Your mom should know some of this stuff also .Answer by joyce k

if you have your citizenship for America, then you can invite your mom legally.
My aunt is from Korean, and now is married to a guy that has citizenship and is now living here.
And she got citizenship, and she wanted her parents to come to America and live with her too.
So she invited her legally.
You can do that.
You should probably get some more information about that.

You are only 18… OK…let me think …when I brought my mother here in 1989, prior to that, I wanted to reiterate to you that I was an IR-1 meaning I was married to an American –so he brought me here in 1978. I would have gotten my citizenship earlier than 1986 if my papers were not lost by INS, El Paso, TX…anyway I brought my both parents here to US. I had to apply for a visa. I had second preference –married to an American, with a job, I had a job too, selling encyclopedias so I did save my earnings to a bank account just to show the INS I could support my parents while in the US. I was also asked to buy round trip tickets for them, so I did gracefully. It took 3 months for the visa approval and 3 months for my parents –all around process to get here. I did not see my parents for 12 years so I was so relieved to meet them again. I was extremely happy.
Now, INS changed all their rules and regs. You go online to find out what you can do. Lawyers are everywhere to help you but since you are 18 (I was 35)–I can’t possibly think how you can afford to hire a lawyer–you have to sell your soul to the devil and that is not the right way to bring your mom here. Tell your mom to be patient. Explain. Life for you will get more complicated if she insists on getting her now. Study. Graduate. Get a good job. Don’t forget that if you earn a diploma, it is always a stepping stone to a good future.

I would go and see an immigration attorney. They are extremely expensive, however, this is not something that you are willing to mess up or make a mistake with. They will know the ins and outs of the immigration system, and will know if there are any loop holes that you can use to get your parents here quicker. But you will have to file forms sponsering your mother for a resident visa.

Answer by George LWell, in order to file an IR-5 immigrant visa petition for your mother, you need to be an American and you need to be over 21. So, once you hit 21, you will be able to file an I-130 immigrant visa petition for her immediately. It will take USCIS six months or more to approve and process the petition and then send it to the National Visa Center, which will then contact you and ask for an Affidavit of Support and then send it on to the embassy. Check out uscis.gov for more information and forms.
