If Burger King one day created a clown mascot, could they be in serious trouble?

Yes, they could be sued. But you can’t say they’d automatically lose just because they created a clown mascot. It would depend on how similar the clown was to Ronald McDonald — is it similar enough to confuse customers, and/or is it similar enough that customers would think McDonald’s was somehow involved or affiliated in the promotion?
