Madhuri: What action should be taken against a restaurant which renamed itself after our restaurant?
Our restaurant’s name is not registered. Can we still take action against our competitors? Moreover our estaurant is running with this name since last 10 months. Please advice.

Did you apply to trademark your name when it opened? If you didn’t you do not have the right to take any action since the name isn’t “yours.” I work for a restaurant that recently opened and took it’s name from the south and they have all the right to do so…

It all depends where you live as the laws vary from But if you did not register or trademark the name when you opened, there may be nothing you can do to prevent others from using the name or a variation of it.
