Greg Fox: What law prevents employers from asking an employee to do something illegal?
I was asked to perform something illegal at my job. I have proof that the person who asked me would have known this request to be unlawful. What law specifically says this is illegal? I live in Texas.Thanks in advance.

If the action is illegal, and you know it.. then your option is to refuse. If you knowingly do something illegal, it makes you part of it.. even if it was directed by the employer.Answer by Shady W
Tread carefully. If the violation is Sarbanes-Oxley related the FTC would be the watchdog. Unless it’s huge you may wish to use to an anonymous reporting number (most large companies have these nowadays).
If it’s a small company, send an anonymous communication in writing to a member of the HR department in some trackable means using an alias. Assuming, of course, you haven’t discussed your concerns with ANY coworker.

Conspiracy. It covers the agreement and planning to commit a crime, regardless that the crime is never actually carried out. If you agree, you run the risk of being charged and convicted along with the other parties. You are not legally required to report a conspiracy in order to avoid guilt, simply refuse to agree.
In Texas, the penalty for conspiracy is one level below the penalty for the actual crime itself.
