Lil mama: What is the best and quickest way to get my fiancee legal?
My fiancee overstayed his Visa and we currently cannot get married in the state we reside because it is expired, we cannot even get his name added to the birth certificate for our daughter. We have begun talking to a lawyer and have tried looking into doing things here, but if it’s impossiable for us to get married here, we are thinking about going to his country and trying to do it from his country. This is causing an emmense strain between the two of us because of the worrying of keeping our family together. If anyone can help I thank you in advance.
To Cristanine atleast we are doing something about the situation. Don’t call us stupid for trying to do things legally. He had every right to be here, he stayed here because of our daughter if that is stupid to you would you have rather had him leave us?
To Astucias he was here going to school I can’t turn him in to an employer. His parents were paying for his schooling, and living expenses.

Marriage laws vary on a state-by-state basis. You should still be able to get married here. If he has an ID, and, a birth certificate. Look up where you can get married.
Don’t get too stressed out by this. Remember where there is a will there is a way, and, keeping your family together is the most important thing.

Answer by MamapeapodIt would seems that your only solution would be that he returns to his home country and you apply in the correct manner from the USA.
Being illegal and overstaying a visa will not help his situation as you have found out. And, I doubt they will reward him with a visa at the present time

A. He need to returns to his home country and you apply for him this is the right thing to do. Staying here illegal will not help his case.
Ok, so he has now “out of status”. To get married you have to be iin country legally, he is not anymore. He will be departed, u ask for fiance visa, but that would be harder now in his case and will take more time than normally. ๐ Now depends what his country is, u can have a beautiful life there too, usa is not anymore land of freedom as it was 10-20 years agoThink on all posibilities. Going to his country better look it up where he is from and make sure this is where you want to live>And will his family except you &Or does he have a family there already> Best do something as his name is on the want list and when caught than choice are all ready made for him> Get your childs & yourself a passport so when you want to come back you can>Answer by woot21215

Depending on which country he’s from, it just may be better to do it there. You can always fly back for a visit. If he gets caught it would be bad for you guy’s trying to return one day.
