There is no legal basis in the Constitution for the IRS to exist and tax our income. For many years after the country was founded there was no such thing as income tax. Income taxes came about as the country grew and the scope of government responsibility increased. The reality is that the USA could not survive now with an income tax.Answer by Mutt
The 16th Amendment give Congress the right to pass laws to tax your income. And they did just that: It’s called the Internal Revenue Code (or U.S. Tax Code), and can be found in Title 26 of the U.S. Code.
If you don’t believe that, just don’t pay it. Explain to the judge that there is no law saying you have to pay income tax and see if he agrees with you. So far, everyone that has tried it has been told they are wrong. But who knows, you may be the first to get a judge to agree with you.

There are only a few limits on that power. Exports cannot be taxed, indirect taxes must be geographically uniform and direct taxes must be apportioned.
The 16th amendment clarifies that income taxes are to be treated as INDIRECT taxes.
“The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.”

Using that power, Congress has enacted several tax laws through the years. In fact, the first income tax law in the U.S. was enacted in 1861 and was NEVER found to be unconstitutional. Our current tax laws get their basic structure from the Tax Reform Act of 1986. It was enacted on October 22, 1986. That law has been amended several times in the years between then and now. The tax laws are codified as Title 26 of the U.S. Code. You can read the 1986 law in the U.S. Statutes at Large in Volume 100 starting on page 2085.
