testamentary trust account? The check makers cannot change the “payable to” and my father`s bank cannot deposit them (even though my mother`s name) is jointly on the account.

Your father, or you, or whoever is the executor of your mother’s estate, needs to talk to the bank about opening an estate account. All such money will be deposited there, and the executor will use those checks to settle all your mother’s legal debts.
