Under Article One of United States Constitution, Commerce Clause the Congress of the United States are given the powers to regulate state commerce.
“The Congress shall have power […] To regulate commerce with foreign nations, and among the several states, and with the Indian tribes”
Allegheny Airlines is subjected such because it is of a private sector. There are laws that regulate private companies, however, government does not have the power to control their cash flow and what’s done with the money.
