Scarlite: I signed a contract 5 days ago for an apartment and now the rental company is trying to change their minds..?
some background: I was searching for an apartment, I had come the day before but they were eager to close so I made an appointment to come back, the day came back the agent was almost an hour late and in the meantime the other agent showed the apartment and rented it to someone else while I was waiting.
So they had a notice from another tenant that day that they were going to vacate their apartment by the 5th so it would be available for me on the 8th.. I went and viewed the apartment and it was perfect!! perfect size, perfect lakeview, perfect floorplan. So I paid the admin fee, the application fee and signed a contract that said I would lease it for 8 months. now 4 days later (yesterday) they called me and said “we have a problem, the other tenants have decided not to move out and the are thinkinf of renewing” my response was “I signed a contract and if I had broken my end of the deal I would have been charged a $ 1400 severance fee!” they are trying to suavly move me into another apartment but I signed a lease for that EXACT APARTMENT.. I’m pretty upset advice please! I WANT THIS APARTMENT!

I’m not being unreasonable I am being f u cked out of what I ALREADY paid for in what is feeling more and more like a bait and switch plan and to have the audacity to say that, holysh i t! IF I WERE TO BREAK MY END OF THE DEAL I WOULD BE HEAVILY PENALIZED BUT THEY CAN JUST DO IT ON THEIR END WITHOUT A SECOND THOUGHT?? THAT’S BULLSHIT! you simply can’t just expect somebody to accept something else after they’ve already paid for it… and they should treat me like the world revolves around me because I am the customer.. all my life I’ve taken s h i t from assholes like you and now I’m tired of it and I wanna stand up for myself.. go f u c k yourself!

You may want it but they are not going to force a tenant to move.Things happen and people aren’t able to move and they are not going to make them move.You are being unreasonable.There is no reason why you can’t accept another apartment.It doesn’t matter what you signed the lease for you cannot force the current people to move out if they are paying the rent.You need to grow up and realize that the world doesn’t revolve around what you want and you don’t always get it the way you want it. The apartment complex is doing the right thing and they are offering you a different apartment,take it or forget any of it.They are not being suave they are being good management.I would offer you another apartment and if you refused,I wouldn’t give you a second thought.
Okay, unfortunately the law is on the letting agent’s side. If YOU break an agreement with them it costs you, but if THEY break the agreement? Nothing happens. It sucks.
I am glad however to hear that the agent offered you other apts and tried to make up for it but if you are as unhappy with them as I think you are, I would just stay away from them. This situation is not a good base for setting up a good landlord/tenant relationship.
Sadly there is little you can do except make sure you get every single penny back off them, including any administration fees you may have paid for background checks, writing up the lease etc. After all, these non-refundable fees should be refunded in this case. IF they refuse to repay you then I suggest that you speak to a lawyer. What would have happened if you had given your previous apt up after signing and now found yourself homeless? You would have to fork out a fortune staying in a half decent hotel until you found somewhere.
And as for what another certain poster says? Take every answer they give with a pinch of salt. So far the only thing I can say for sure with them is DO NOT RENT FROM THEM! 15 yrs property management? Yeah I can see how they’ve been doing it so long. She must be raking in the dough screwing renters and spending as little as possible! Lol!
I have never seen a tenant-friendly answer yet. Only ones that help and support unscrupulous landlords with fleecing as much out of renters as humanly possible.

You signed a contract – but did you make sure the contract didn’t have any fine print that allows the management company to provide you another apartment in place of the contracted one? Also, if you’ve had this much trouble all ready with the company do you really want to live there and have to deal with them for 8 months? just a thought.
