: Can filing for divorce end a subpoena for court report of earnings and health insurance info?
One of my friend’s parents are married but separated. Her dad moved out on his wife to be with another woman and so the wife just recently filed through domestic relations a court earnings report and health insurance subpoena. How can he fight back? They live in Pennsylvania by the way. Could he file for a divorce or does he have to live with that for a while? Could that prevent him from getting a divorce?

He will have to provide this information either way. This information is used in divorce proceedings.

The subpoena only indicates that her father must provide information about his earnings and health information. A subpoena is not something you contest — it just means that you are supposed to provide the requested information. The subpoena usually accompanies some other kind of suit, such as a suit for child support or a suit for alimony. It’s important to know what kind of suit this is before knowing whether or not to contest the suit.
Now if this is part of a child support suit, and your friend is indeed living with her mom, then there is no point in fighting it. There are state-mandated guidelines for how to award child support based on one’s income. You can’t usually get a judge to award less than the state-mandated amount.
If this is part of a suit for alimony, then it is possible to contest that, but I would need to know if that is what this is before continuing on with an explanation.
As for whether alimony or child support will impact the divorce, the answer is no, it won’t have an impact. He can file for a divorce. The other court orders can be handled separately, or incorporated into the official divorce decree, depending on which cases are resolved first.
