.: Capital One credit card, “claiming” they never received my final payment?
After my husbands’ SGLI, finally arrived, I immediately paid off all of our debts. I sent all of the out of town creditors bank drafts from my bank account. Then I went down to the post office, mailed them out with return receipts, and mail confirmation. Just to make sure the creditors received their final payment. According to the US Post Office website, all of the payments arrived, and I return receipts from all of the companies we owed money to.
Since June of last year, Capital One has been “claiming” that the final payment was never received, and they are now suing me for close to $ 5,000 for the debt, attorneys fees, and late charges. I have submitted to Capital One, my bank draft, a copy of the return receipts, and a copy of the mail confirmation number. And yet they still insist they never received my final payment.
Capital One was calling my house 5-10 times a day, sending me emails, and sending out bills for a debt that I already paid. At the beginning of January I had to hire an attorney to get Capital One off of my back. Yesterday he went to court on my behalf, and settled the case. Capital One put me through so much misery and heart ache over a $ 2500 credit card, that was in my husbands’ name. I was NOT legally obligated to pay off the debt, but I did it because it was the right thing to do. I wanted to sue Capital One for harrassment, but my attorney said it would cost more to sue them then it would be for him to go to court to settle the matter.
Has anyone been through anything like this with Capital One credit card? I would like to hear your story. Please no rude answers, thank you.

I Feel for you and I give my condolances for your loss.
Capital One is a buisiness and they don’t care how they get their money. They saw a hole of $ 2500 and need to fill it. You were their best bet to get that money. You did right by covering your husbands debt. They were a horrible company for how they went about it…however that is the nature of the beast. Its over now, look forward, not backwards.
i assume you sent the payment using a check of some sorts
if it was on your personal checking account look at your statements and see if it has been payed. if it has request a copy from your bank, make a copy for your records, and send a copy to capital one showing them you made the payment
if it was by cashier’s check or money order i hope you kept a copy for your records. contact the company that issued the check or money order and see if it has been payed. get the name and number of the person you talked to. provide that information to capital one
i have used my canceled checks to prove payments
i have researched cashier’s checks and money orders i thought were fraudulent and found out when the actual document was cashed
Answer by jlfWhy don’t you have the BANK verify if the bank draft was CASHED or not? That’s the way to provide proof of payment.Answer by D J
You need to get the copy of the receipt for the mail & the canceled check from your bank. Write a letter to Capital One stating the the bill was paid. Include the proof that you paid the bill. State that since they have been paid, they can no longer call your about this debt. If they continue to call you will sue them. If you need a example of the “drop dead letter” check out www.clarkhoward.com, he’s our local WSB-750 Rdaio & HLN (formerly Headline Line News) consumer guru. Then get a cheap answering machine & let the machine answer the call. That way you also have a recording of the harassment if you have to go to court. Good Luck
